Limited liability and indemnity

Read this first. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure. Nothing on this page excludes, restricts or modifies those guarantees or any other right you have under Australian law that cannot lawfully be excluded. Where a term below would do so, it does not apply to you.

Limitation of liability

Subject to the paragraph above, and to the extent the law permits, Concrete Mould Company Australia is not liable for indirect, consequential, special or incidental loss arising from your use of, or inability to use, a product bought from this website, and our total liability for any claim relating to a product is limited to the amount you paid for that product.

Using the products safely

These are moulds for casting concrete. Cement is caustic, wet concrete is heavy, and mixing and pouring it is physical work. Follow the safety directions on the cement or concrete you buy, wear appropriate protective equipment, and keep children and pets away from a pour. We cannot supervise how a mould is used, so you are responsible for working safely on your own site.

Indemnity

To the extent the law permits, and other than where a claim arises from our own negligence, breach of the consumer guarantees, wilful misconduct or fraud, you agree to indemnify Concrete Mould Company Australia and BuyFactory Direct Pty Ltd against claims brought by a third party that arise from the way you have used a product bought from this website.

Availability and delays

We are not responsible for a delay caused by a carrier or by circumstances outside our reasonable control. If we cannot fulfil an order we will tell you and refund it. This does not affect your rights under the Australian Consumer Law.

Jurisdiction

These terms are governed by the law of New South Wales, Australia.
